This website is operated by Formforged (Pty) Ltd, registration number 2026/542800/07. Throughout this website, the terms “Formforged”, “we”, “us” and “our” refer to Formforged (Pty) Ltd and its trading divisions, Formforged 3D and Formforged Tech.
By accessing our website, creating an account, requesting a quotation, booking a service or purchasing a product from us, you agree to these Terms and Conditions and the policies referred to in them.
Please read these Terms and Conditions before using our website. If you do not agree to them, you should not use the website or place an order.
Nothing in these Terms and Conditions excludes or limits any rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or any other applicable South African law.
1. Use of our website
You must be at least 18 years old or have the consent and assistance of a parent or legal guardian to place an order.
You may not use our website, products or services:
- For an unlawful or unauthorised purpose;
- To infringe another person’s intellectual-property rights;
- To transmit viruses, malware or harmful code;
- To gain unauthorised access to our systems;
- To submit false, fraudulent or misleading information; or
- To interfere with the operation or security of the website.
We may suspend or terminate access to the website where it is reasonably necessary to protect Formforged, our customers or our systems.
2. Products and services
We make reasonable efforts to ensure that product descriptions, specifications, prices and images are accurate.
Product colours and appearance may differ slightly because of screen settings, manufacturing batches or material variations. Manufacturers and distributors may also change product specifications without prior notice.
Products and services may be withdrawn, replaced or discontinued at any time. This will not affect orders already accepted by Formforged, unless the product becomes unavailable and we offer you an alternative or refund.
3. Prices
All prices are displayed in South African rand and include applicable taxes unless clearly stated otherwise.
Delivery, installation, design, repair or other additional charges will be shown separately where applicable.
Prices may change without notice. A price change will not affect an order that has already been accepted, except where:
- The displayed price was an obvious error;
- A distributor changed the price before we accepted the order; or
- The customer requested a change to the order.
Where an incorrect price is discovered, we will notify you and allow you to accept the corrected price or cancel the affected product for a refund.
4. Orders
Placing an order constitutes an offer to purchase the selected products or services.
An order is only accepted once Formforged has confirmed the order and received any required payment or deposit.
We may reject or cancel an order where:
- A product is unavailable;
- The displayed price or description contains a material error;
- Payment cannot be verified;
- We reasonably suspect fraud or misuse;
- Delivery cannot reasonably be completed to the supplied address; or
- Fulfilling the order would be unlawful.
Where we cancel a paid order, we will refund the amount paid for the cancelled goods or services.
You must ensure that your contact, billing, delivery and order information is accurate and complete.
5. Payment
Payment must be made using one of the payment methods offered on our website, quotation or invoice.
Orders will not normally be processed or dispatched until cleared payment or the required deposit has been received.
You are responsible for ensuring that you are authorised to use the selected payment method.
6. Delivery
Delivery dates are estimates unless Formforged has expressly agreed to a specific date in writing.
Delivery may be affected by stock availability, distributors, manufacturers, couriers, public holidays and circumstances outside our reasonable control.
You must provide a complete and accurate delivery address and ensure that someone is available to receive the order.
Risk in the product passes to you when the product is delivered to you or a person authorised by you, subject to applicable consumer law.
Please inspect the parcel as soon as reasonably possible and report visible damage, missing items or incorrect products promptly.
7. Special-order products
Some products are ordered from a distributor or manufacturer only after the customer places an order.
Stock availability and delivery dates for special-order products are subject to confirmation by the relevant distributor.
Once a special-order product has been ordered from or accepted by a distributor, cancellation may be subject to reasonable costs already incurred, where permitted by law.
Special-order status does not remove any statutory cooling-off, defect or warranty rights that apply to the transaction.
8. Custom 3D printing and design
Custom 3D-printed, personalised and made-to-order products are manufactured according to customer-approved requirements.
The customer is responsible for checking and approving:
- Dimensions;
- Text and spelling;
- Colours and materials;
- Quantities;
- Designs and layouts;
- Intended use; and
- Customer-supplied files.
Normal characteristics of 3D printing may include visible layer lines, seams, minor support marks, small colour variations and reasonable dimensional tolerances. These will not be considered defects where the product materially complies with the approved specifications.
Formforged is not responsible for faults caused by incorrect measurements, unsuitable designs or errors in files supplied or approved by the customer.
Custom products cannot ordinarily be returned because of a change of mind, but this does not affect rights relating to defective or incorrectly manufactured products.
9. Customer-supplied content and intellectual property
You confirm that you own or have permission to use any designs, logos, photographs, models, STL files, trademarks or other content supplied to Formforged.
You must not ask Formforged to manufacture products that unlawfully infringe another person’s intellectual property or other legal rights.
You grant Formforged permission to use supplied content only to the extent reasonably necessary to prepare quotations, manufacture the requested products and provide the agreed services.
We may refuse work that we reasonably believe is unlawful, unsafe or infringes another person’s rights.
Unless otherwise agreed in writing, Formforged retains ownership of original designs, drawings, templates and production files created by us. Payment for a product does not automatically transfer ownership of the underlying design or working files.
10. Computer, laptop and printer services
Before submitting a computer, laptop, storage device or other electronic equipment for repair, you should back up important information wherever possible.
Although Formforged will take reasonable care, electronic repairs may involve a risk of data loss, software corruption or factory resetting.
We will not perform additional chargeable work beyond the approved quotation without obtaining your authorisation.
A quotation may be revised if further faults or damage are discovered after the equipment has been opened or tested. You may accept or reject the revised quotation.
Formforged is not responsible for pre-existing faults, hidden damage or data loss that was not caused by a failure to exercise reasonable care.
11. Returns, cancellations and warranties
Returns, cancellations, exchanges, defective products and refunds are governed by our Returns, Refunds and Cancellations Policy.
Manufacturer and distributor warranties may apply to certain products. Formforged will assist customers with valid warranty claims for products purchased from us.
Nothing in a manufacturer or distributor warranty replaces or reduces rights provided by South African consumer law.
12. Privacy
Personal information submitted through our website or provided when purchasing products or services is processed in accordance with our Privacy Policy and applicable data-protection law.
By placing an order, you authorise us to share information reasonably required to complete the transaction with payment providers, couriers, distributors, manufacturers and service centres.
13. Third-party services and links
Our website may use or link to third-party services, including payment gateways, couriers, manufacturers, distributors and external websites.
Third-party websites and services are governed by their own terms and privacy policies. Formforged does not control their content, availability or security.
This does not affect Formforged’s responsibilities regarding products or services purchased directly from us.
14. Reviews, comments and submissions
You are responsible for reviews, comments and other content submitted through our website or social-media pages.
Submitted content must not be unlawful, defamatory, threatening, misleading, offensive or infringe another person’s rights.
By submitting a review or comment for publication, you grant Formforged permission to display, reproduce and moderate that content for reasonable business and marketing purposes.
We may remove content that violates these Terms or applicable law.
15. Website availability
We do not guarantee that the website will always be uninterrupted, secure or error-free.
We may temporarily suspend, update or discontinue parts of the website for maintenance, security or operational reasons.
We are not responsible for interruptions caused by internet providers, hosting providers, payment services, cyberattacks or other events outside our reasonable control.
16. Errors and omissions
The website may occasionally contain errors relating to product descriptions, prices, stock availability, delivery charges or promotional offers.
We may correct these errors and notify affected customers.
Where an error materially affects an order, the customer may accept the corrected information or cancel the affected portion of the order for a refund.
17. Limitation of liability
To the maximum extent permitted by law, Formforged will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the transaction was concluded.
Formforged will not be responsible for loss caused by:
- Misuse of a product;
- Failure to follow instructions;
- Unauthorised repairs or alterations;
- Customer-supplied files, measurements or designs;
- Incompatible third-party hardware, software or accessories;
- Events outside our reasonable control; or
- Use of a product for an undisclosed or unintended purpose.
Nothing in these Terms excludes liability for fraud, gross negligence or any liability or consumer right that cannot lawfully be excluded.
18. Indemnity
You agree to be responsible for claims, losses or costs arising directly from:
- Your unlawful use of the website;
- Your material breach of these Terms;
- Content or files supplied by you that infringe another person’s rights; or
- False or misleading information provided by you.
This section applies only to the extent permitted by South African law.
19. Termination
You may stop using our website at any time.
We may restrict or terminate your use of the website where you materially breach these Terms, use the website unlawfully or threaten the security of our systems.
Termination does not affect rights, payment obligations or liabilities that arose before termination.
20. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply.
21. Entire agreement
These Terms, together with the policies and order-specific terms referred to on our website, constitute the agreement between you and Formforged regarding use of the website and purchases made through it.
Any special quotation, invoice or written agreement will apply together with these Terms. Where there is a direct conflict, the specific written agreement will apply to that transaction, subject to applicable law.
22. Governing law
These Terms and all transactions with Formforged are governed by the laws of the Republic of South Africa.
Nothing in these Terms prevents a consumer from exercising a right to approach an appropriate consumer authority, ombud, tribunal or court.
23. Changes to these Terms
We may update these Terms from time to time by publishing the revised version on our website.
Changes will apply from the date of publication and will not retrospectively alter an order already accepted, unless required by law or agreed with the customer.
